A cyclist’s recovery and
compensation claim

Jamie Kerr was cycling to an early shift when a split-second mistake changed everything.

It was a cold, misty weekday morning, and the roads were slick with drizzle. Jamie, a 34-year-old warehouse team leader, was riding along a busy commuter route when a car pulled out from a side road, misjudging the gap. Jamie braked hard, but the front wheel slid on the wet surface. He clipped the car’s bumper and was thrown onto the tarmac.

“I remember the sound before I remember the pain,” Jamie said. “It was like my body hit the ground before my brain caught up.”

A passer-by stopped traffic and stayed with Jamie until the ambulance arrived. He was taken to the hospital, where scans confirmed multiple injuries, including:

  • a fractured pelvis
  • a displaced wrist fractured (his dominant hand)
  • serious soft-tissue damage to his hip and lower back
  • a concussion

Jamie needed surgery to stabilise a displaced wrist fracture, followed by a lengthy period of limited mobility and strict weight-bearing restrictions. He went from being active and independent to needing help with basic tasks at home.

“The first time I tried to stand up on my own, I realised how much I’d taken for granted,” he said. “I couldn’t even make a cup of tea without feeling exhausted and frustrated.”

The impact on Jamie’s work and life

Before the accident, Jamie’s job involved long shifts, being on his feet all day, and occasional heavy lifting. After discharge, it became clear he couldn’t return to work quickly, and there were real concerns about whether he’d be able to go back to the same role at all.

His wrist injury affected grip strength and fine movement, while the pelvic fracture left him with ongoing pain, disrupted sleep, and difficulty walking or standing for long periods.

“I kept telling myself I’d be back in a few weeks,” Jamie said. “Then the weeks became months. I started worrying about money, my job, and whether this was just my life now.”

Jamie also began avoiding cycling altogether and felt anxious around traffic, even as a passenger in a car.

“I didn’t recognise it as anything ‘serious’ at first,” he said. “But I’d replay the accident in my head at night. I was snappy with everyone. I didn’t want to talk about it because I felt stupid for being ‘just a cyclist’.”

How HDClaims helped

Jamie’s family encouraged him to get advice, and that’s when he contacted HDClaims. From the outset, our focus was on what Jamie needed to recover, not just the legal process.

Using the Rehabilitation Code, we sought early rehabilitation support so Jamie could access treatment quickly rather than waiting on NHS timelines alone. This included:

  • Physiotherapy tailored to pelvic injury recovery and gait retraining
  • An occupational therapy assessment at home to improve safety and independence
  • Psychological support to address accident-related anxiety and sleep disruption

The occupational therapist recommended practical changes to reduce strain during recovery, including equipment to help Jamie move safely around the house and strategies to manage daily tasks without worsening pain.

Jamie said: “It wasn’t just exercises, it was someone looking at how I actually lived day to day. That made a massive difference.”

Supporting the claim properly

As Jamie’s recovery progressed, it became clear that the accident would have long-term consequences. We gathered evidence to reflect the true impact, including medical expert opinions on:

  • Orthopaedic prognosis and future symptoms
  • The likely duration of rehabilitation
  • Ongoing vulnerability to flare-ups and reduced tolerance for physical work
  • psychological effects following a traumatic road collision

We also considered Jamie’s employment situation. Even once he returned to work, he was moved onto lighter duties and reduced hours. There was uncertainty about whether he could sustain the same role long-term without risking setbacks.

An early settlement offer was made, but it didn’t account for the wider picture, especially future loss of earnings, continued treatment needs, and the knock-on effects on Jamie’s independence and quality of life.

We challenged that valuation using the expert evidence and a clearer breakdown of Jamie’s past and future losses. Where appropriate, we also pursued interim payments, so Jamie could stay afloat financially while the case continued and continue treatment without interruption.

The outcome

After further negotiation, Jamie’s case concluded with a significantly improved settlement of £475,000.

The settlement reflected:

  • The severity of Jamie’s physical injuries and ongoing symptoms
  • The cost of rehabilitation and future treatment needs
  • loss of earnings and reduced earning capacity
  • care and assistance provided by family during recovery
  • The psychological impact of the accident

Jamie said: “It’s not ‘winning’, I’d undo the whole thing in a second if I could. But it means I can breathe again. I’m not panicking every month about bills, and I can plan my life without feeling like I’m one bad day away from everything falling apart.”

Looking forward

Jamie is now back at work in a role that’s less physically demanding, and he continues to manage flare-ups with a long-term plan that includes targeted exercise and pacing strategies. He’s also gradually rebuilding confidence around roads, starting with short, quiet routes before considering a return to cycling.
