Cyclist secures compensation
after driver pulled out and caused
a collision
Mark was slowing to a stop at a mini-roundabout on his way to work when a driver pulled out without checking properly and struck him.
A regular commuter and confident rider, Mark had done what he always did to stay safe. He wore a bright cycling jacket with reflective strips, ran front and rear lights even in daylight, and positioned himself clearly in the lane so he wouldn’t be squeezed at the junction.
But as he approached the roundabout, a car waiting to enter edged forward, then suddenly moved off.
“I had barely any time to react,” Mark said. “One second I was rolling in, the next I was hit and on the ground. I remember hearing my bike scrape along the road and thinking, ‘How did they not see me?’”
The driver stopped a short distance away. Mark was shaken and in pain, and passers-by stepped in to guide traffic and call an ambulance. Paramedics checked him at the roadside before taking him to the hospital for further assessment.
Scans confirmed Mark had suffered:
- a fractured collarbone
- a fracture to a rib
- heavy bruising and soft-tissue injury to his shoulder and hip
- concussion symptoms, including dizziness and headaches
Mark was discharged with a sling, pain relief, and advice to rest. In the days that followed, the reality of the injury set in. Sleeping was difficult, and simple tasks like lifting a kettle, getting dressed, or carrying shopping became painful.
“It sounds small until you’re living it,” he said. “I couldn’t lift my arm, and I couldn’t concentrate for long because of the headaches. Work became impossible.”
As the weeks went on, Mark’s recovery was slower than expected. While his bones began to heal, the pain and stiffness in his shoulder lingered, and he lost confidence on the road.
“I didn’t want to admit how much it got to me,” he said. “But I kept replaying the moment it happened. I’d tense up whenever a car came close.”
When it became clear Mark would be off work for longer than he’d hoped, and that the costs of travel, missed wages, and treatment were mounting, he contacted HDClaims for help.

How HDClaims supported Mark
From the start, we focused on getting Mark practical support as well as progressing the claim. Using early rehabilitation routes, we helped him access physiotherapy to rebuild strength and mobility in his shoulder, and we ensured his ongoing concussion symptoms were properly assessed.
We also gathered the evidence needed to build the case, including:
- accident scene details and photographs
- witness accounts
- medical records and independent medical reports
- proof of financial losses, including time off work and out-of-pocket expenses
The driver’s insurer initially suggested Mark had been “too close” to the vehicle and questioned his road position. We challenged that quickly, supported by the evidence and the Highway Code principles around cyclists taking a visible, safe road position at junctions. Liability was then accepted.
As Mark’s recovery continued, the full effect of the accident became clearer. He had needed months of treatment, endured persistent pain and disrupted sleep, and lost confidence cycling, something that had been part of his daily life for years.
An initial offer was made, but it didn’t reflect the ongoing symptoms, the length of recovery, or the wider impact on Mark’s work and wellbeing. We pushed back, supported by updated medical evidence and a detailed schedule of losses.
The outcome
The case concluded with a settlement of £18,750, reflecting Mark’s injuries, treatment needs, time off work, and the disruption the collision caused to his life.
